Terms & Conditions

These Terms govern your use of the SnagMate mobile application.

Welcome to SnagMate. By downloading, installing or using the SnagMate mobile application (the App), you agree to be bound by these Terms of Service (Terms). Please read them carefully. If you do not agree, do not use the App.

Version history summary: Version 1.0 is the initial and current legal release.

1. About SnagMate

SnagMate is a community-driven mobile application that allows users to post and discover time-sensitive local deals, discounts, grocery markdowns, pub specials, and nature strip freebies within their local area. SnagMate is a community notice board. We do not sell products, facilitate transactions, or endorse any deal posted on the platform. All content is created and posted by users.

2. Acceptance of Terms

By using the App you confirm that:

  • You are at least 13 years of age.
  • You are capable of entering into a binding agreement.
  • You have read, understood and agree to these Terms.
  • You will comply with all applicable Australian laws and regulations.

If you are under 18 years of age, you must not engage with alcohol-related content on the App.

3. User Accounts

3.1 Registration

You may browse the App without creating an account. To post deals, you must sign in using Google Sign-In or Apple Sign-In. By signing in you authorise SnagMate to access your basic profile information from those providers.

3.2 Account Responsibility

You are responsible for all activity that occurs under your account. You must not share your account credentials with anyone. Notify us immediately at snagmate-legal@proton.me if you suspect unauthorised use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms or engaged in behaviour harmful to other users or the community.

Upon termination, your right to use the App ceases immediately. However, these Terms will continue to apply to any prior use of the App, and any provisions that by their nature should survive termination shall survive, including Sections 5, 6, 10 and 11.

4. User-Generated Content

4.1 Your Content

When you post a deal, photo, price or any other content to SnagMate (User Content), you grant SnagMate a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content within the App for the purpose of operating the service.

4.2 Content Standards

You must not post content that:

  • Is false, misleading or deceptive.
  • Promotes illegal activity.
  • Is defamatory, harassing, abusive or threatening.
  • Infringes any third party intellectual property rights.
  • Contains personal information of others without their consent.
  • Is sexually explicit or pornographic.
  • Promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
  • Advertises alcohol to persons under 18 years of age.
  • May harm the reputation of a business through false or misleading information.
  • You do not have the right to use, including images sourced from the internet without permission.

4.3 Business Content Disclaimer

SnagMate is not responsible for verifying the accuracy of business-related content posted by users. SnagMate disclaims all liability for any business losses, reputational harm or financial damage arising from user-generated content relating to any business, venue or establishment.

4.4 Location Accuracy

All deals you post must be posted from your current physical location. Posting deals for locations you are not physically present at is prohibited. SnagMate uses your device GPS to verify your location at the time of posting.

4.5 Deal Expiry

All deals posted on SnagMate automatically expire within a set timeframe based on category. Expired deals are automatically removed. You must not attempt to circumvent the expiry system.

4.6 Content Moderation

SnagMate does not undertake to monitor all content and does not guarantee the accuracy, integrity or quality of any User Content. We reserve the right to remove any User Content at any time, without notice, that we determine in our sole discretion violates these Terms or is otherwise harmful to our community. Our failure to remove content does not constitute endorsement of that content.

5. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, SNAGMATE PROVIDES THE APP ON AN AS IS AND AS AVAILABLE BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

SnagMate does not warrant that:

  • Any deal posted on the App is accurate, current, available or genuine.
  • The App will be uninterrupted, error-free or secure.
  • Any product or service discovered through the App meets your expectations.
  • The App is free of viruses or other harmful components.

You use the App and act on any deal posted at your own risk. SnagMate is a community notice board only. We do not verify deals before they are posted.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE AUSTRALIAN LAW, SNAGMATE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY:

  • Loss of profit, revenue or data.
  • Personal injury or property damage arising from your use of or reliance on the App.
  • Illness, harm or damage caused by food, products or items discovered through the App.
  • Loss arising from alcohol-related incidents connected to deals posted on the App.
  • Injury arising from the collection or use of nature strip freebies posted on the App.
  • Any indirect, incidental, special, consequential or punitive damages.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.

To the extent permitted by law, our liability for breach of any non-excludable guarantee is limited to the resupply of the services or the cost of having the services supplied again, whichever is the lesser amount.

7. Personal Safety

You are solely responsible for your personal safety when acting on any information obtained through the App, including travelling to locations, collecting items from nature strips, or interacting with third parties. SnagMate accepts no responsibility for any harm, injury, loss or damage arising from your physical attendance at any location discovered through the App.

Always exercise your own judgement and take reasonable precautions when acting on deal information. Do not enter private property or engage in any unsafe behaviour when collecting nature strip freebies or attending deal locations.

8. Alcohol Content

SnagMate displays information about licensed venues and alcohol-related deals. SnagMate does not sell, supply or facilitate the purchase of alcohol. Information about pub deals or specials is community-posted information only.

Access to alcohol-related sections is restricted to users who confirm they are 18 years of age or older. Where available, SnagMate may also apply additional technical checks from sign-in provider claims to support minimum age enforcement. By accessing alcohol-related content on the App, you warrant that you are of legal drinking age in your jurisdiction (18 years or older in Australia). If you provide false information about your age, you accept full responsibility for any consequences arising from that misrepresentation.

Users who do not confirm they are 18+ (or are identified as under 18) will have alcohol-related content hidden from their experience. SnagMate accepts no liability for alcohol-related incidents, harm or damage arising from use of the App.

9. Nature Strip Freebies

SnagMate allows users to post items left on nature strips for collection by others. By collecting any nature strip freebie discovered through the App:

  • You do so entirely at your own risk.
  • SnagMate makes no representation as to the safety, condition or legality of any item posted.
  • SnagMate accepts no liability for injury, damage or loss arising from the collection or use of any such item.
  • You are responsible for ensuring collection complies with your local council regulations.
  • You are solely responsible for your personal safety when travelling to and collecting any item.

10. Indemnity

You agree to indemnify, defend and hold harmless SnagMate and its operator, affiliates, officers, employees and agents from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or access to the App.
  • Your User Content.
  • Your breach of these Terms.
  • Your violation of any applicable laws or regulations.
  • Your violation of any third party rights including intellectual property rights.
  • Any claim by a third party relating to content you have posted on the App.

This indemnity obligation will survive termination of these Terms and your use of the App.

11. Intellectual Property

The SnagMate name, logo, app design and all original content created by SnagMate are owned by the operator and protected by Australian intellectual property laws. You must not reproduce, distribute or create derivative works from our intellectual property without prior written consent.

User Content remains owned by the user who posted it. By posting content you represent and warrant that:

  • You own or have the right to post that content.
  • The content does not infringe any third party intellectual property rights.
  • You have not sourced images from the internet without proper permission or licence.

12. Third Party Services

The App uses the following third party services, each governed by their own terms:

  • Google Sign-In, governed by Google Terms of Service.
  • Apple Sign-In, governed by Apple Terms of Service.
  • Google Maps, governed by Google Maps Terms of Service.
  • Firebase, governed by Google Firebase Terms of Service.

SnagMate is not responsible for the practices of any third party service providers.

13. Reporting and Moderation

Users may report deals that are fake, expired or inappropriate. SnagMate uses automated systems to hide content that receives multiple reports. We reserve the right to review and take action on reported content at our sole discretion. SnagMate does not guarantee that all reported content will be reviewed or removed.

Misuse of the reporting system to target other users is prohibited and may result in account suspension.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

15. Changes to Terms

We may update these Terms at any time. We will notify users of material changes through the App or via push notification. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
